Foreclosure is the process that is started by a bank and it involves a homeowner. Now these situations end up with the bank foreclosing on the homeowner and its real estate portfolio enriches with one more property.

But something else happened in Collier County, Florida. Instead of Bank of America foreclosing on some Florida homeowner, the homeowners had sheriff’s deputies foreclose on the bank.

The whole story started five months ago, when the nation’s biggest lender, Bank of America filed foreclosure papers on the home of a couple, who were absolutely clear on their home, didn’t owe a dime to the bank, because they paid cash for the property.

After the case went through court and the couple presented hard evidence that confirmed their statement, moreover, the couple never even had a mortgage bill to pay, the Collier County Judge ruled Bank of America to pay the legal fees of the homeowner’s Maurenn Nyergers and her husband. The judge said, Bank of America wrongfully foreclosed on the couple’s house.

Although the court ruled the bank to put the money on the table, even after 5 months of the ruling, the lender didn’t show any interest in paying the legal fees. So the couple’s attorney did exactly what the bank tried to do the homeowners: seized the bank’s assets.

“They’ve ignored our calls, ignored our letters, legally this is the next step to get my clients compensated, ” attorney Todd Allen said.

So what happened next: movers, sheriff’s deputies and Nyergers’s attorney went to the bank and foreclosed on it, Todd Allen giving the instructions to remove desks, computers, copiers, filing cabinets and any cash in the teller’s drawers.

Not even after an hour of being locked out of the bank, the bank manager showed up with the late check for the legal fees and handed the attorney.

Allen, the couple’s attorney said this can be seen quite often in court, banks making errors because they didn’t investigate the foreclosure.
